On December 31, 2017, Calumet
GP, LLC, the general partner (the “General Partner”) of Calumet Specialty Products Partners, L.P. (the “Partnership”), entered into Amendment No. 3 to the First Amended and Restated Agreement of Limited Partnership of the Partnership, dated as of January 31, 2006, as amended by Amendment No. 1 and Amendment No. 2 to First Amended and Restated Agreement of Limited Partnership of the Partnership, dated as of July 5, 2006 and April 15, 2008, respectively, effective as of December 31, 2017 (the “Amendment”), to make certain revisions in response to changes to the Internal Revenue Code enacted by the Bipartisan Budget Act of 2015 (the “BBA”), which are designed to facilitate the General Partner’s obligations as the “Partnership Representative”
under the BBA.
