* On November 13, 2020, the United States Bankruptcy Court for the Southern District of Texas (the “Bankruptcy Court”) held a hearing to consider confirmation of the Fifth Amended Joint Plan of Reorganization for the Debtors under Chapter 11 of the Bankruptcy Code (as it may be amended, supplemented or otherwise modified, the “Plan”). On November 13, 2020, the Bankruptcy Court entered an order confirming the Plan. Pursuant to the terms of the Plan, among other things, all of the Company’s existing equity interests, consisting of authorized and outstanding shares of its common stock, par value $0.01 per share, were cancelled.
